General Terms and Conditions of Sale

The following General Terms and Conditions of Sale govern the offer and sale of products on this website, www.hifidiprinzio.it (the Site), by Hi-Fi Di Prinzio S.a.s., with legal headquarters in Chieti, Viale Benedetto Croce 437 - 66100 Chieti Scalo (Chieti - Italy). VAT number 01248150698 (Hi-Fi Di Prinzio).

 

  • Scope of Application

 

      1. The sale of products through the Site (Products) constitutes a distance contract governed by Chapter I, Title III (Articles 45 et seq.) of Legislative Decree No. 206 of 6 September 2005 (Consumer Code) and by Legislative Decree No. 70 of 9 April 2003, which contains the regulations on electronic commerce.
      2. The General Terms and Conditions of Sale may be modified at any time. Any changes and/or new conditions will be effective from the moment of their publication on the Site. For this reason, users are encouraged to regularly access the Site and consult the most updated version of the General Terms and Conditions of Sale before making any purchase. The applicable General Terms and Conditions of Sale are those in effect at the time of the order submission.
      3. These General Terms and Conditions of Sale do not govern the sale of products and/or the provision of services by parties other than Hi-Fi Di Prinzio that are present on the Site through links, banners, or other hyperlinks. Before engaging in commercial transactions with such parties, it is necessary to verify their terms of sale. Hi-Fi Di Prinzio is not responsible for the provision of services and/or the sale of products by such parties. Hi-Fi Di Prinzio does not perform any control and/or monitoring of the websites accessible through such links. Therefore, Hi-Fi Di Prinzio is not responsible for the content of these sites nor for any errors and/or omissions and/or legal violations committed by them.

 

  • Purchases on the Site

 

    1. Access to sales made through the Site is reserved exclusively for users who are 18 years of age or older.
    2. Hi-Fi Di Prinzio reserves the right to refuse or cancel orders that originate (i) from a user with whom it is in a legal dispute; (ii) from a user who has previously violated these General Terms and Conditions of Sale and/or the conditions and/or terms of a purchase contract with Hi-Fi Di Prinzio; (iii) from a user involved in any type of fraud, particularly credit card fraud; (iv) from users who have provided false, incomplete, or otherwise inaccurate identification data, or who have not promptly submitted to Hi-Fi Di Prinzio the documents required under these General Terms and

Conditions of Sale, or who have submitted invalid documents; (v) from users who do not provide sufficient solvency guarantees.

 

  • Registration on the Site

 

      1. Registration on the Site is free of charge.
      2. The registration credentials must be used exclusively by the user and cannot be transferred to third parties. The user agrees to keep them confidential and ensure that no one else has access to them, as well as to promptly inform Hi-Fi Di Prinzio, by contacting them as indicated in Article 13, in case of suspected misuse and/or disclosure of the credentials. The user guarantees that the personal information provided during the registration process on the Site is complete and truthful. The user agrees to hold Hi-Fi Di Prinzio harmless from any damage, liability, or penalty arising from and/or in any way related to the user's violation of the registration rules on the Site or the safeguarding of registration credentials.

 

  • Information for the Conclusion of the Contract

 

    1. In accordance with Legislative Decree No. 70 of 9 April 2003, containing provisions on electronic commerce, Hi-Fi Di Prinzio informs the user that:
  • to conclude the purchase contract for one or more Products on the Site, the user must complete an electronic order form and submit it to Hi-Fi Di Prinzio electronically, following the instructions that will appear from time to time on the Site and that will accompany the various stages of the purchase;
  • the contract is concluded when the order form reaches the Hi-Fi Di Prinzio server;
  • once the order form is registered and the payment authorization for the total amount due has been received, Hi-Fi Di Prinzio will send the user, via e-mail to the address provided, an order confirmation containing information regarding the characteristics of the purchased Product, detailed pricing, the payment method used, information on the right of withdrawal, delivery charges, any additional costs, and contact information for Customer Service, to which the user can turn for assistance and/or to file complaints. It is recommended to keep the received e-mail as proof of purchase. The applicable General Terms and Conditions of Sale for the order, as well as the standard instructions on withdrawal and the standard withdrawal form referred to in Article 10, will be attached to the e-mail confirming the shipment of the purchased product.
  • the order form will be stored in Hi-Fi Di Prinzio's database for the time necessary to process the order and, in any case, in accordance with the law. To access their order form, the user may consult their account.

 

  • Validity of offers and prices

 

      1. All Product prices are expressed in Euros (€) and include Value Added Tax ("VAT"). Any additional costs will be clearly and separately indicated on the order form before the user proceeds with its submission.
      2. The price of the Products may be changed by Hi-Fi Di Prinzio at any time, without notice, provided that the price charged to the user will be the one published on the product information page (Product Page) at the time of order submission. Any price changes (either increases or decreases) occurring after the order has been submitted will not be taken into account.
      3. The Site may offer Products for sale at discounted prices. The full price listed on the Site (Crossed-Out Price), against which the discount applied by Hi-Fi Di Prinzio is calculated, corresponds to the manufacturer's suggested retail price published on the Site.

 

  • Purchase orders - Product Information

 

    1. Hi-Fi Di Prinzio will process the purchase order and ship the purchased Product only after receiving confirmation of payment authorization for the total amount due, consisting of the purchase price, delivery charges, if applicable, and any other additional costs, as indicated on the order form (Total Amount Due). If the Total Amount Due is not paid or payment confirmation is not received, the purchase contract will be automatically terminated pursuant to Article 1456 of the Italian Civil Code. The user will be promptly notified of this termination and the consequent cancellation of the order through the Site.
    2. The Products will remain the property of Hi-Fi Di Prinzio until the user has made full payment of the Total Amount Due. However, the risk of loss or damage to the Products, due to causes not attributable to Hi-Fi Di Prinzio, will pass to the user when the user, or a third party designated by the user other than the carrier, physically takes possession of the Products.
    3. Each Product is accompanied by a Product Page available on the Site. The images and descriptions on the Site aim to faithfully reproduce the characteristics of the Products. However, the actual colors of the Products may differ due to the settings of the computer systems or devices used by the users for viewing. Additionally, the images of the Product on the Product Page may differ in size or in relation to any

accessory products. These images should therefore be considered indicative and subject to reasonable tolerances. For the purposes of the purchase contract, the description of the Product provided in the order form submitted by the user will prevail.

 

  • Product Availability

 

    1. The products offered on the Site are limited in quantity. Therefore, it may happen that the ordered Product is no longer available after the submission of the purchase order, especially due to the possibility of multiple users purchasing the same Product at the same time.
    2. In the event of unavailability of the ordered Product, without prejudice to the rights granted to the user by law, particularly under Chapter XIV of Title II of Book IV of the Civil Code, the user will be promptly informed by e-mail. The user will then be entitled to immediately terminate the contract, without prejudice to the right to compensation for damages, in accordance with the provisions of Article 61, paragraphs IV and V of the Consumer Code. If the user exercises the right of termination under Article 61, paragraphs IV and V of the Consumer Code, or in any case where the Total Amount Due has already been paid, Hi-Fi Di Prinzio will, without undue delay and in any event within a maximum of 15 working days from the order submission, refund this amount. The refund amount will be communicated to the user via e-mail and will be credited to the same payment method used by the user for the purchase. Any delays in the crediting may be due to the bank, the type of credit card, or the payment solution used. In any case, the value date will be the same as the charge date.
    3. In the case of orders consisting of multiple Products (Multiple Orders), if the unavailability only affects some of the Products in the Multiple Order — without prejudice to the rights granted to the user by law, particularly under Chapter XIV of Title II of Book IV of the Civil Code, and subject to the application of Article 7.2 above — if the unavailability affects all the Products in the order, Hi-Fi Di Prinzio will immediately notify the user via e-mail. The user will then be entitled to immediately terminate the contract, but only for the unavailable Product(s), without prejudice to the right to compensation for damages, in accordance with the provisions of Article 61, paragraphs IV and V of the Consumer Code. If the user exercises the right of termination under Article 61, paragraphs IV and V of the Consumer Code with respect to the unavailable Product(s), or in any case where the Total Amount Due has already been paid, Hi-Fi Di Prinzio will, without undue delay and in any event within a maximum of 15 working days from the order submission, refund the amount due for the unavailable Product(s), including delivery charges, if applicable,

and any other additional costs specific to those Products (Partial Amount Due). The refund amount will be communicated to the user via e-mail and credited to the same payment method used by the user for the purchase. Any delays in the crediting may be due to the bank, the type of credit card, or the payment solution used. In any case, the value date will be the same as the charge date. The termination of the entire Multiple Order will only be possible if it is evident and proven that the unavailable Products in the Multiple Order are accessories to the available Products in the Multiple Order.

 

  • Delivery of Purchased Products

 

    1. Hi-Fi Di Prinzio delivers Products both in Italy and abroad. The delivery charges due by the user for a specific order, where applicable, are expressly and separately indicated (in Euros, including VAT) during the purchase process, in the order summary, and in any case before the user proceeds with submitting the order. If no specific delivery term is indicated, delivery will, in any case, occur within thirty days from the date of contract conclusion.
    2. In the case of partial withdrawal from Multiple Orders, the amount of delivery charges to be refunded to the user will be proportionate to the value of the Product subject to withdrawal.
    3. The delivery obligation is fulfilled by transferring the material availability or control of the Products to the user.

It is the user's responsibility to check the condition of the Product delivered/collected. Notwithstanding that the risk of loss or damage to the Products, not attributable to Hi- Fi Di Prinzio, is transferred to the user when the user, or a third party designated by them other than the carrier, takes material possession of the Product, it is recommended that the user verify the number of Products received and ensure that the packaging is intact, not damaged, wet, or otherwise altered, including in the sealing materials, and it is in the user's interest to indicate any anomalies on the carrier's delivery note, accepting the package with reservation. Receiving the Products without reservations prevents the user from taking legal action against the courier in the event of loss or damage to the Products, except in cases where the loss or damage is due to the courier's intentional misconduct or gross negligence, and except for partial loss or damage not recognizable at the time of delivery, provided that in the latter case, the damage is reported as soon as discovered and no later than eight days after receipt. If the package shows obvious signs of tampering or alteration, it is also recommended that the user promptly notify Customer Service. In any case, the provisions regarding the right of withdrawal and the legal guarantee of conformity remain applicable.

 

  • Payment Methods

 

      1. Payment for Products can be made by credit card, PayPal, PostePay, or bank transfer. If any of these payment methods are not available for a specific Product, this will be clearly indicated on the Site, at the latest, at the start of the purchase process.
      2. The invoice will be issued based on the information provided by the user, who declares and guarantees that the information is true, and undertakes to hold Hi-Fi Di Prinzio harmless from any damages, including penalties issued by the competent authorities, that may result from the inaccuracy of the information.

 

  • Payment by credit or debit card

 

        1. Payment for Products can be made via credit or debit card directly on the Site.
        2. To ensure secure payments and prevent fraud, Hi-Fi Di Prinzio reserves the right to request the user to send, via e-mail, a front and back copy of their identity card and, if the order holder is different from the cardholder, the identity card of the latter. The document must be valid. The e-mail will specify the deadline for submitting the document, which will not exceed 5 working days from receipt of the request. The order will be suspended until the requested document is received. The user is required to send the requested documents within the specified deadline.
        3. If Hi-Fi Di Prinzio does not receive the documents within the specified period or receives expired or invalid documents, the contract will be terminated by law under Article 1456 of the Civil Code, and the order will be canceled, without prejudice to Hi-Fi Di Prinzio's right to compensation for any damages incurred due to the user's non-compliance. The user will be notified of the contract termination via e- mail within 5 working days after the deadline for submitting the requested documents. The contract termination will result in the cancellation of the order and the refund of the Total Amount Due.
        4. If Hi-Fi Di Prinzio receives valid documentation within the deadline specified in the e-mail referenced in Article 9.3.2, the delivery times will start from the date of receipt of the documentation.
        5. Credit card data (card number, cardholder, expiration date, security code) are encrypted and transmitted directly to the payment processor without passing through Hi-Fi Di Prinzio's servers. Hi-Fi Di Prinzio does not access or store the credit card data used by the user, except for the cardholder's name in the cases outlined in Articles 9.3.2 and 9.3.3.

 

  • Payment via PayPal

 

        1. Products purchased on the Site can be paid for using PayPal. If the user selects PayPal as the payment method, they will be redirected to www.paypal.it, where they will complete the payment according to PayPal’s procedures and terms and conditions agreed upon with the user. The data entered on PayPal’s site will be processed directly by PayPal and will not be transmitted or shared with Hi-Fi Di Prinzio. Therefore, Hi-Fi Di Prinzio does not know or store the credit card data linked to the user’s PayPal account or any other payment method associated with that account.
        2. When paying via PayPal, the Total Amount Due will be charged by PayPal at the time the contract is concluded through the Site. In the event of contract termination or any other refund, the amount will be credited to the user's PayPal account. The crediting time to the payment method linked to the PayPal account depends solely on PayPal and the banking system. Once the credit order is placed in favor of the PayPal account, Hi-Fi Di Prinzio cannot be held responsible for any delays or failures in the crediting process. The user should contact PayPal directly to contest such issues.

 

  • PostePay

 

        1. If the user chooses to use PostePay, the payment will be processed via PayPal. The same provisions outlined in Article 9.4 apply.

 

  • Bank Transfer

 

      1. In case of payment by bank transfer, after completing the order, the user must make the payment to Hi-Fi Di Prinzio's bank account. The user can request the IBAN by contacting Hi-Fi Di Prinzio via phone.

Users should request bank transfer details by phone or e-mail at customercare@hifidiprinzio.it.

For payments via bank transfer, the delivery times for the Product indicated on the Product Page and/or the Site will start from the date Hi-Fi Di Prinzio receives the transfer, not from the order transmission date, as is the case with other payment methods.

 

  • Right of Withdrawal

 

    1. Users who qualify as consumers have the right to withdraw from the contract concluded with Hi-Fi Di Prinzio without incurring costs other than those outlined in this article and without providing any reason, within fourteen (14) calendar days (Withdrawal Period). The Withdrawal Period expires after 14 days:
  1. in the case of an order for a single Product, from the day the user or a third party, other than the carrier and designated by the user, acquires physical possession of the Product;
  2. in the case of a Multiple Order with separate deliveries, from the day the user or a third party, other than the carrier and designated by the user, acquires physical possession of the last Product; or
  3. in the case of an order for the delivery of a Product consisting of multiple lots or pieces, from the day the user or a third party, other than the carrier and designated by the user, acquires physical possession of the last lot or piece.
  1. To exercise the right of withdrawal, the user must inform Hi-Fi Di Prinzio of their decision to withdraw before the Withdrawal Period expires.
  2. To this end, the user may:
  1. use the model withdrawal form (Model Withdrawal Form) available on the Site, through a dedicated link, before the conclusion of the contract, and, in any case, through the "Right of Withdrawal" link present on the Site and attached to the shipping confirmation e-mail; or
  2. submit any other explicit declaration of their decision to withdraw from the contract (Withdrawal Declaration).

The Model Withdrawal Form or the Withdrawal Declaration must be sent to the following e-mail address: customercare@hifidiprinzio.it.

As the burden of proof regarding the exercise of the right of withdrawal before the expiry of the Withdrawal Period lies with the user, it is in the user's interest to use a durable medium when communicating their withdrawal to Hi-Fi Di Prinzio.

  1. For the return of the Product, the user may use a carrier of their choice with return costs borne by the user: in this case, the user, after exercising the right of withdrawal as indicated in this article, must return the Product to Hi-Fi Di Prinzio, using a carrier of their choice and at their expense, without undue delay and in any event within 14 calendar days from the date they communicated their decision to withdraw to Hi-Fi Di Prinzio. The deadline is met if the user sends back the Product before the 14-day period has expired. The Product, properly protected and packaged, must be shipped to the following address: Hi-Fi Di Prinzio S.a.s. with registered office in Chieti, Viale Benedetto Croce 437 - 66100 Chieti Scalo (Chieti - Italy).

The direct costs of returning the Product to Hi-Fi Di Prinzio are borne by the user. The return of the Product to Hi-Fi Di Prinzio is the user's responsibility; the product is considered returned when it is delivered to the carrier.

If the user has used a discount code for the purchase of the Product for which they have exercised the right of withdrawal, the refund will only be made concerning the amount of money actually spent by the user, and not the value of the discount code.

  1. If the user withdraws from the contract, Hi-Fi Di Prinzio will refund the Total Amount Due paid by the user for the Product, excluding delivery costs (initial shipping), if applicable, without undue delay and in any event within 14 calendar days from the day Hi-Fi Di Prinzio was informed of the user's decision to withdraw from the contract. The refund will be made using the same payment method used by the user for the initial transaction; in any event, the user will not incur any costs as a result of such a refund.
  2. In the case of partial withdrawal, the amount of delivery costs to be refunded to the user following the withdrawal will be calculated as indicated in Article 8.3 above.
  3. The user is only liable for any diminished value of the goods resulting from handling other than that necessary to establish the nature, characteristics, and functioning of the Product. The Product must, in any event, be stored, handled, and inspected with ordinary care and returned intact, complete in all its parts, fully functional, with all accessories and leaflets, with identification tags, labels, and the single-use seal, where present, still attached to the Product and intact and not tampered with, as well as perfectly suitable for its intended use and free of signs of wear or dirt. The withdrawal applies to the Product as a whole. It cannot, therefore, be exercised concerning parts and/or accessories (that do not constitute independent Products) of the Product.
  4. If the withdrawal is not exercised in accordance with the applicable law, it will not result in the termination of the contract and, consequently, will not entitle the user to any refund. Hi-Fi Di Prinzio will notify the user within 5 working days from the receipt of the Product, rejecting the withdrawal request. The Product, if already delivered to Hi-Fi Di Prinzio, will remain with Hi-Fi Di Prinzio at the user's disposal for collection, which must occur at the user's expense and responsibility.
  5. If the Product for which the withdrawal has been exercised has undergone a decrease in value resulting from handling other than that necessary to establish the nature, characteristics, and functioning of the Product, the refund amount will be reduced by an amount equal to such decrease in value. Hi-Fi Di Prinzio will inform the user of this circumstance and the consequent reduced refund amount within 5

working days from the receipt of the Product, providing the user with bank details for payment of the amount due by the user due to the decrease in value of the Product, if the refund has already been made.

  1. If, in accordance with the law, the right of withdrawal does not apply, this exclusion will be explicitly and specifically communicated in the Product Sheet and, in any event, during the purchase process, before the user proceeds to place the order. It is also reminded that, pursuant to Article 59 of the Consumer Code, the right of withdrawal is excluded, among other cases, in the event that the sale concerns:
  1. products made to measure or clearly personalized;
  2. sealed products that are not suitable for return for hygienic or health protection reasons, if they have been unsealed after delivery.

 

  • Legal Warranty of Conformity

 

 

All Products sold on the Website are covered by the Legal Warranty of Conformity provided for in Articles 128-135 of Legislative Decree No. 128-135 of the Consumer Code (Legal Warranty).

WHO IT APPLIES TO

The Legal Warranty is reserved for consumers. It, therefore, applies only to users who have made a purchase on the Website for purposes unrelated to any entrepreneurial, commercial, artisanal, or professional activity they may engage in. Those who have purchased on the Website and are not considered consumers will be subject to the warranties for defects of the item sold, warranty for defects in promised and essential qualities, and other warranties provided by the civil code with the respective terms, forfeitures, and limitations.

WHEN IT APPLIES

The seller is liable to the consumer for any lack of conformity existing at the time of delivery of the Product and that becomes apparent within two years from that delivery. The lack of conformity must be reported to the seller, under penalty of forfeiture of the warranty, within two months from the date it was discovered.

Unless proven otherwise, any lack of conformity that becomes apparent within six months of the delivery of the Product is presumed to have already existed on that date, unless this presumption is incompatible with the nature of the Product or the nature of the lack of conformity. Starting from the seventh month following the

delivery of the Product, the consumer is responsible for proving that the lack of conformity already existed at the time of delivery.

To benefit from the Legal Warranty, the user must provide proof of the purchase and delivery date of the item. Therefore, the user should keep the purchase invoice, which Hi-Fi Di Prinzio sends, or any other document that can confirm the date of purchase (e.g., a credit card statement) and the delivery date.

WHAT IS A LACK OF CONFORMITY

A lack of conformity exists when the purchased item:

  • is not suitable for the use that goods of the same type are typically used for;
  • does not match the description made by the seller and does not possess the qualities of the good that the seller presented to the consumer as a sample or model;
  • does not exhibit the usual qualities and performance of a good of the same type that the consumer can reasonably expect, considering the statements made in advertising or labeling;
  • is not suitable for the particular use that the consumer intended and that was brought to the seller's attention at the time of the contract conclusion, and that the seller accepted.

 

Failures or malfunctions or defects of any other kind caused by accidental events or the user's responsibility, or by using the Product in a way that is not consistent with its intended use and/or with the instructions provided in the technical documentation attached to the Product, if available, or in the usage instructions, are excluded from the scope of the Legal Warranty.

USER REMEDIES

In case of a duly reported lack of conformity within the terms, the user has the right to:

  • primarily, the free repair or replacement of the item, at their choice, unless the requested remedy is objectively impossible or excessively burdensome compared to the other. In this case, given the type of sale, the replacement is possible in relation to the number of items still available for sale;
  • secondarily (in the event that repair or replacement is impossible or excessively burdensome or repair or replacement has not been carried out within a reasonable time or the repair or replacement previously performed has caused significant inconvenience to the consumer), a price reduction or contract termination, at their choice.

The requested remedy is excessively burdensome if it imposes unreasonable expenses on the seller compared to the alternative remedies that could be applied, taking into account (i) the value that the good would have if there were no lack of conformity;

(ii) the extent of the lack of conformity; (iii) the possibility that the alternative remedy could be applied without significant inconvenience to the consumer.

WHAT TO DO IN THE PRESENCE OF A LACK OF CONFORMITY

If a Product purchased on the Website shows what might be a lack of conformity during the validity period of the Legal Warranty, the user must contact Customer Service at the contacts and in the manner indicated in Art. 14. Hi-Fi Di Prinzio will promptly respond to the communication regarding the alleged lack of conformity and inform the user of the specific procedure to follow, also to agree on the methods of shipping the goods, considering the product category to which the Product belongs and/or the defect reported.

REFUND OR REDUCTION IN CONSEQUENCE OF THE APPLICATION OF THE LEGAL WARRANTY

In the event of contract termination, Hi-Fi Di Prinzio will refund the total amount paid by the user, consisting of the purchase price of the Product (excluding shipping costs) and any other additional costs. In case of a price reduction, Hi-Fi Di Prinzio will refund the amount of the reduction, previously agreed upon with the user. Alternatively, the user can choose to receive a purchase voucher, redeemable on the Website, of equivalent value to the refund amount or the reduction to which they are entitled.

The refund or reduction amount will be communicated to the user via e-mail and credited using the method or payment solution used by the user for the purchase.

Hi-Fi Di Prinzio is not liable for any damages of any nature resulting from the improper use of the Product and/or use not conforming to the instructions provided by the manufacturer, as well as for damages resulting from accidental events or force majeure.

 

  • Applicable law and jurisdiction; Out-of-Court Dispute Resolution - Alternative Dispute Resolution/Online Dispute Resolution

 

    1. Contracts concluded between users of the Site and Hi-Fi Di Prinzio are governed by Italian law. This is without prejudice to the application to consumer users who do not have their habitual residence in Italy of any more favorable and mandatory provisions provided by the law of the country in which they have their habitual

residence, particularly in relation to the period for exercising the right of withdrawal, the period for returning Products, in the event of exercising such a right, the procedures and formalities of the communication thereof, and the legal guarantee of conformity.

  1. In the case of consumer users, any disputes relating to the application, execution, and interpretation of these General Terms and Conditions of Sale shall be referred to the court of the place where the user resides or has elected domicile.
  2. Pursuant to Article 141-sexies, paragraph 3 of Legislative Decree September 6, 2005, No. 206 (Consumer Code), Hi-Fi Di Prinzio informs users who qualify as consumers under Article 3, paragraph 1, letter a) of the Consumer Code, that if they have submitted a complaint directly to Hi-Fi Di Prinzio, and it has not been possible to resolve the dispute thus arisen, Hi-Fi Di Prinzio will provide information regarding the Alternative Dispute Resolution entity or entities for the out-of-court resolution of disputes concerning obligations arising from a contract concluded under these General Terms and Conditions of Sale (ADR entities, as indicated in Articles 141-bis et seq. of the Consumer Code), specifying whether or not it intends to use such entities to resolve the dispute.

Hi-Fi Di Prinzio also informs users who qualify as consumers under Article 3, paragraph 1, letter a) of the Consumer Code, that a European platform for online consumer dispute resolution (ODR platform) has been established. The ODR platform can be accessed at the following address: http://ec.europa.eu/consumers/ odr/; through the ODR platform, consumer users can consult the list of ADR entities, find the link to each of their websites, and initiate an online dispute resolution procedure in which they are involved.

In any case, the consumer user's right to bring the dispute before the ordinary competent court is reserved, regardless of the outcome of the out-of-court dispute resolution procedure via the procedures provided in Part V, Title II-bis of the Consumer Code.

Users residing in a European Union member state other than Italy can also access, for any dispute relating to the application, execution, and interpretation of these General Terms and Conditions of Sale, the European procedure established for small claims disputes, as per Regulation (EC) No. 861/2007 of the Council, dated July 11, 2007, provided that the value of the dispute does not exceed, excluding interest, fees, and expenses, €2,000.00.
